1Acceptance of Terms

Welcome to Central Montréal (we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website (the "Site") and any purchase you make through it.

By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

2Eligibility

You must be at least the age of majority in your province or territory of residence (or otherwise have the legal capacity to enter into a binding contract) to place an order on this Site. By using the Site, you represent that you meet this requirement.

3Products & Pricing

We source overstock and unsold inventory from major retailers. All products listed are described and represented as accurately as possible, but we do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free.

• Prices are listed in Canadian dollars (CAD) unless otherwise stated, and are subject to change without notice.
• We reserve the right to limit quantities, refuse service, or cancel orders at our discretion, including in cases of suspected fraud, pricing errors, or unavailable inventory, and will notify you and issue a refund if we cancel an order you've already paid for.
• Applicable taxes are calculated and added at checkout based on your shipping destination, as described further on our Shipping & Returns page.

4Orders & Payment

When you place an order, you're making an offer to purchase the item(s) in your cart. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or issues identified during fraud screening.

Payments are processed securely through Stripe. We do not store your card number on our servers. See our Privacy Policy for details on how payment information is handled. By submitting an order, you authorize us (via our payment processor) to charge your chosen payment method for the full order total, including applicable shipping and tax.

5Shipping & Returns

6Accounts & Order Information

You're responsible for providing accurate, current information (including your shipping address and email) when placing an order. We are not responsible for orders delayed, misdelivered, or lost due to incorrect information provided at checkout.

7Acceptable Use

You agree not to use the Site to:

• Violate any applicable law or regulation;
• Submit false, fraudulent, or misleading information (including placing fraudulent orders);
• Attempt to gain unauthorized access to any part of the Site, our systems, or related networks;
• Interfere with or disrupt the Site's operation, including through malware, scraping, or automated bulk requests; or
• Infringe on the intellectual property or other rights of any third party.

8Intellectual Property

All content on the Site, including text, graphics, logos, images, and the overall design, is owned by or licensed to Central Montréal and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent, except as necessary to place a personal, non-commercial order.

Product images and brand names displayed on the Site remain the property of their respective owners and are used to accurately identify the products we sell.

9Disclaimers & Limitation of Liability

The Site and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

To the maximum extent permitted by applicable law, Central Montréal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any products purchased through it. Nothing in these Terms is intended to limit any rights you may have as a consumer under applicable Québec or Canadian consumer protection legislation that cannot be waived by contract.

10Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11Governing Law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts located in Montréal, Québec, Canada, unless applicable consumer protection law provides otherwise.
